TERMS AND CONDITIONS
By purchasing and taking part in one of our tours, you agree and accept our terms and conditions outlined below. If you are purchasing a tour on behalf of someone else, you agree and accept our terms and conditions on their behalf. If you do not agree with any of the terms and conditions below, you may contact the owners via email or phone to discuss your concerns; or you may withdraw from and cancel your tour. Rules for refunds because of non-acceptance are the same as our normal cancellation policies below. Without making your objections known to the owners/operators before the start of your tour, you accept and agree to our terms and conditions below.
1. RESERVATION & CANCELLATION POLICY
For Group Tours: You may cancel anytime up to 24 hours before the start of the tour to receive a full refund. A cancellation link is included in your tour confirmation.
For Private Tours: A 50% deposit is required at the time of your reservation. The last 50% payment is due two weeks before the date of the tour.
If you cancel up to 2 weeks before the date of your tour, you will receive a full refund.
If you cancel between 7 to 14 days before the date of your tour, you will receive a 50% refund.
If you cancel within 7 days before the date of your tour, no refund will be issued.
All Tours: All tours operate rain or shine. Only if weather conditions are unsafe will the tour be cancelled at the discretion of the operator.
The operator reserves the right to cancel a tour at anytime due to unsafe weather, unforeseen emergencies or rescheduling conflicts. If this occurs, customers will have the option to reschedule or cancel for a full refund. If the customer cannot reschedule and has to cancel, the operator will make best efforts to recommend a similar tour with another company.
2. LIABILITY
As standard practice, we will do our best to keep you safe, including giving you some safety instructions at the beginning of the tour (ie. Looking both ways when crossing streets and bike lanes to avoid possible accidents with bikes, scooters and cars; be aware of your surroundings at all times; discourage mobile phone use while walking between stops, etc…).
But during the tour you are ultimately responsible for your own health and safety; well-being and personal possessions. This includes knowing and practicing commonly accepted safety rules; following basic city rules involving pedestrians; and conducting yourself in a lawful, socially accepted manner. You are also responsible for the health, safety, well-being and personal possessions of any minors/children accompanying you on the tour.
You are responsible for all damages and losses incurred to you and minors/children accompanying you, that may occur during the tour as a result of physical accidents during the tour, including, but not limited to: while visiting private and public locations; from transportation related incidents; from criminal activity; from bad weather, from acts of nature: from the loss of, misplaced or stolen property; and /or from medical services or evacuation personnel not readily available.
We will not be liable for any losses and damages incurred to you (and to any minors/children accompanying you) by the actions of other entities such as, but not limited to: vehicles and the actions of their drivers/operators; store and restaurant owners and their workers; museums and their staff; city street workers and their equipment; boating and other tour-related companies; other tour group members; and the tour operators and owners.
We will not be liable for any incidents caused by factors beyond our control, such as bad weather, acts of nature, war, terrorist attacks and criminal activities.
You agree to take this tour at your own risk and accept all risks of illness, injury, mental conditions, unforeseen incidents and/or death.
If you feel unsafe at any time or feel uncomfortable with any of the guide’s suggestions during the tour, immediately address your concerns to the tour guide.
Disruptive and disrespectful behavior will not be tolerated. We reserve the right to ask you to leave the tour or remove you from the tour without a refund. You are personally responsible for any physical injuries, damages or losses of property caused by you and any minors/children accompanying you during the tour to third parties.
3. NAME AND LIKENESS
By purchasing and participating in one of our tours, you give Amsterdam and You Walking Tours the right to photograph, film and/or record you during the tour and give us the right to use the recorded media to promote our products and brand on our website and through our social media channels.
If you do not wish to filmed, photographed or recorded, please let the tour guide know at the beginning of the tour and we will make sure to exclude you from any filming and/or recording.
FINAL ACCEPTANCE & AGREEMENT
You forever release Amsterdam and You Walking Tours, its employees, assigns, partners, owners, affiliates, officers, successors and agents from any liability that may arise from participating in any of our tours. You also acknowledge and accept that these terms, in written form here, are legally binding personally for you, your family, your assigns, your successors, heirs and any representatives to the full scope of the law.
You agree that any claims will be handled in the jurisdiction of Dutch Law and the Dutch Courts. They will first be brought to arbitration and if and only if, the claims cannot be resolved there, will they be allowed to be heard in a Dutch court.
